Terrorism is one of the most pressing issues for criminal law and policy in the present time. In the United Kingdom, the problem of terrorism is one that has been protracted over a long period of time. Clive Walker has said that in the British history with terrorism, there are three phases of legislative action that can be seen in response to terrorism (Walker, 2005). The first phase saw responses to terrorist conduct in colonial conflicts. The second phase saw the responses to the Irish Republican campaigns.

Public interest immunity is a rule of the law of evidence, developed over a period of time under the common law, under which parties to legal proceedings may not be able to get the disclosure of documents if such a disclosure is shown to be injurious to the public interest.

Tom is not criminally liable for the damage under the Criminal Damage Act 1971. Making the statement regarding ‘burning the place down’ was not intended to actually do so. The arson was caused by Jerry and not by Tom. Tom made a statement in frustration and did not really intend to burn down the barn. He did not do any act to start the fire.

Till as late as 2003, rape trials in the UK suffered from the malignant flaws that went against the fundamental rights of rape victims, and that had no place in the 20th century. The attrition rate was very high, it was difficult to prove non-consent in an adversarial system that is structured to be in favour of the accused, and victims were still being asked about their previous sexual behaviour in court to prove that they were promiscuous, and were somehow responsible for what had happened to them.

In the English law, the offence of murder contains two necessary elements: killing of a person and intention (or recklessness or negligence) of the accused. In case killing occurs but the defendant has a justified defence, such as provocation, or diminished responsibility, the offence is not indictable as murder, but may be indictable as manslaughter. The difference between murder and manslaughter hinges entirely on intention of the defendant. It is a fine line and there is no statutory direction on this point. There is however, much caselaw on this issue and this can be used to understand the criminal liability of Peter in this situation.

A person is guilty of arson only if they commit an offence within the Criminal Damage Act 1971, s.1(1) or 1(2). For the applicability of s.1(1), the property destroyed should belong to another. As this is not the case, this provision is not applicable to Tom. For the applicability of s.1(2), a person is guilty of an offence of criminal damage if he had the intention to destroy property or showed recklessness in whether he destroyed such property. Unless the above mentioned elements are present in the case, there will be no offence.

The information has been collated after speaking with the offender, Michael; the victim and the victim’s mother; the therapist working with Michael at this time; Michael’s social worker; and the police officer in charge of investigation into the offence.

The Coroners and Justice Act 2009 (CJA 2009) introduced ‘loss of control’ as a new partial defence to murder. Loss of control as a defence has replaced ‘provocation’. One of the reasons why the change was made in the existing defence of provocation was because of the gendered nature of the defence which allowed men to access it as a defence for killing female partners in a fit of jealousy while failing to accommodate the defence to suit a woman who killed her abusive partner.

The question as to whether the youth should be taken into custody or allowed to go into education centres generally depends on whether the youth is to be treated as someone responsible for his own actions or someone who is a special deserving case.

Desmond is criminally liable for damage of property under Criminal Damage Act 1971 (CDA 1971). Breaking the front window of Candice’s house constitutes a criminal act.
